Quiz Squirrel is operated by Basement Squirrel Games LLC, a Missouri limited liability company located at 134 Tuscany, Wentzville, MO 63395, United States ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of Quiz Squirrel's website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is sexually explicit, obscene, or pornographic
• Promotes violence, discrimination, or hatred
• Contains personal information of others without consent
• Is spam, advertising, or commercial solicitation
• Impersonates another person or entity

4.3 Prohibited Conduct

6. Subscriptions and Payments

6.1 Subscription Plans

Quiz Squirrel offers free and paid subscription tiers. Paid subscriptions provide access to premium features as described on our pricing page. Subscription fees are billed in advance on a monthly or annual basis.

6.2 Billing

• You authorize us to charge your payment method for all fees
• Subscriptions automatically renew unless canceled
• We reserve the right to change pricing with 30 days notice
• You are responsible for all applicable taxes

Refunds — 14-day money-back guarantee: If you are not satisfied, you may request a full refund within 14 days of your initial purchase or of any renewal charge by contacting us; we will refund that payment and downgrade your account to the free tier. After 14 days, fees are non-refundable except where required by law. Separately, if you are a consumer in the EU or UK you have a statutory right to withdraw from a purchase within 14 days; our 14-day guarantee is intended to meet or exceed that right. 6.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the end of that period.

7. Third-Party Services

Quiz Squirrel integrates with third-party services (Facebook, Tumblr, Stripe). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for:

• Third-party service availability, functionality, or security
• Actions or policies of third-party services
• Content or data shared with third-party services
• Any disputes between you and third-party services

9. Disclaimers and Limitations of Liability

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.2 User Content

We do not control user-generated content and are not responsible for its accuracy, quality, legality, or appropriateness. You use the Service and interact with other users at your own risk.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZ SQUIRREL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Quiz Squirrel, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Your content posted on the Service

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to conflict of law principles, and the state and federal courts located in Missouri shall have exclusive jurisdiction. Nothing in these Terms deprives a consumer of the protection of mandatory provisions of the law of their country of residence.

11.2 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve any dispute informally. We will attempt to resolve disputes in good faith.

11.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. You waive your right to a jury trial and to participate in class actions. This arbitration and class-action waiver does not apply where prohibited by law, including to consumers resident in the EU or UK, who may bring claims in the courts of their country of residence.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quiz Squirrel regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

12.3 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

12.4 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.
